Terms of Sales
These General Conditions of Sale (hereinafter referred to as "GTC") are addressed to any user registering on this website and who has an obligation to expressly accept them in order to do so.
It is therefore imperative that all Customers are aware of the T & Cs in that they define the rules for using the Site. Registration on the Site as a Customer implies full acceptance of the GTCS.
When the Customer initiates registration and then validates an order with VINTAGE OPERANDI on the Site and ticks the box "I accept the general conditions of sale", he acknowledges having previously read the GTC and accepting them without restriction.

ARTICLE 01. CONTRACTING PARTIES
The GTC constitute a contract which binds:
- Customers holding an Account on the Site,

- The company VINTAGE OPERANDI, a simplified joint stock company, with capital of 10,000.00 euros, registered in the Paris Trade and Companies Register under number B 891 315 129, whose registered office is 82 boulevard des Batignolles 75017 Paris, represented by its President duly authorized for this purpose, hereinafter referred to by her commercial name "VINTAGE OPERANDI",

ARTICLE 02. DEFINITIONS
In the GTC, words or expressions beginning with a capital letter have the following meaning:
- Customer: any natural person who registers on the Site with a view, in particular, to being able to access information on items, purchase items and take advantage of various other services offered by VINTAGE OPERANDI, on their Account.
- Account: the space of the Site accessible only to the Customer who holds it, on indication of his Username and password.
- Username: the e-mail address allowing a Customer to access his Account on the Site by completing it with his password.
- Service (s): any type of service offered on the Site by VINTAGE OPERANDI to Customers and, in particular, those able to make online purchases of items and access information relating to their current or previous orders.
- Site: this website, in particular accessible at the following address: www.Vintage Operandi.com.
ARTICLE 03. PURPOSE
The T & Cs govern the terms and conditions of the Services, in particular those of being able, for Customers, to make purchases of items for sale on the Site and to access information relating to their current or previous orders.
ARTICLE 04. CONTRACTUAL DOCUMENTS
It is specified that, in the relations between VINTAGE OPERANDI and the Customer, the GTCS supplemented by the Confidentiality Policy and the General Conditions of Use govern all of their contractual relations and apply to the exclusion of any other agreement. . MAKE LINKS ON THE PAGES
VINTAGE OPERANDI advises anyone visiting the Site to save or print the T & Cs, without modifying them.
VINTAGE OPERANDI reserves the right to modify the T & Cs at any time by publishing a new version of them on the Site.
In this case, any order in progress will remain subject to the previous T & Cs. The modifications will come into force as soon as they are posted on the Site and will therefore be enforceable against any Customer as soon as they are accepted. In the event of acceptance, any new order and, more generally, the contractual relationship between the Customer and VINTAGE OPERANDI will be subject to these modified T & Cs.
Any Customer who does not accept the modified T & Cs will no longer be able to continue to access the Site and the contract will be terminated by application of the "TERMINATION" article.
VINTAGE OPERANDI reserves the right to modify, at any time, certain features of the Site or to add new ones which will be automatically subject to these T & Cs.
ARTICLE 05. ACCESS TO SERVICES
The Services are as follows:
- The creation and management of an Account, individual and removable at any time by the Customer,
- Access to this Account allowing the Customer to use the functionalities posted on the Site, including, in particular, the possibility of placing orders online and of accessing information relating to current and previous orders.
The services are reserved for Customers only.
ARTICLE 06. THE CREATION OF AN ACCOUNT BY CUSTOMERS
Any Customer wishing to benefit from the Service must first register on the Site by following the instructions on the latter.
It is strictly forbidden for a Customer to register on the Site under several identities or under a false identity.
VINTAGE OPERANDI reserves the right to remove access to the areas of the Site reserved for the presentation of the Client's ID and, consequently, access to the Services resulting from a Client whose ID will be is contrary to good morals or would be unlawful, without notice or compensation in favor of the Customer, or prejudice to the rights of VINTAGE OPERANDI. The same will apply if any message with similar characteristics is sent to VINTAGE OPERANDI.
The registration process cannot be completed if one of the mandatory fields is not completed or the "I accept the general conditions of sale" box is not checked.
VINTAGE OPERANDI reserves the right to ask any Customer to justify the information communicated during the registration procedure. These must be complete and accurate on the date of the Customer's registration on the Site.
In case of modification of this information, the Customer undertakes to correct them, without delay, within his Account.
VINTAGE OPERANDI cannot verify the identity of Customers or the veracity of the information provided by them.
Consequently, the Customer recognizes that any false information or has become such, communicated by him, is likely to engage his responsibility towards VINTAGE OPERANDI.
The Customer chooses his Username and password. It is up to him to regularly change his password, from his Account. It is strongly recommended not to choose a password constituting a common word, but to alternate numbers and letters, lowercase and uppercase.
The Customer is solely responsible for his Username and password and for the use he makes of them. He expressly agrees to keep his password confidential and not to communicate it under any circumstances to anyone. Consequently, the Customer expressly acknowledges that entering any Username and password constitutes proof of his identity and manifests his consent to all the operations which will be carried out on the Site following his identification.
The Customer must ensure that his e-mail address is valid during the period of his registration on the Site at the risk of not being able to access it, in particular in the event of loss of his password.
A Client's account is strictly personal and cannot therefore be transmitted, by any means whatsoever, to a third party, even free of charge.
VINTAGE OPERANDI cannot be held responsible for any prejudice that Customers may suffer as a result of the use by a third party of their Username and password. In the event of loss, misappropriation or fraudulent use of all or part of his Username and password, the Customer must immediately notify VINTAGE OPERANDI. He remains responsible for any use made of his Username and password before having informed VINTAGE OPERANDI and it has been able, within a reasonable time, to modify them. In the event that a Customer disseminates or uses his Identifier in a manner contrary to its intended purpose, VINTAGE OPERANDI reserves the right to terminate the contract and to remove access to the Account as well as the content accessible from it, and this without notice or compensation. VINTAGE OPERANDI may also take legal action to obtain compensation for any damage it may suffer as a result of this distribution or use.
These stipulations are expressly considered to be substantial between the parties.
ARTICLE 07. DESCRIPTION OF SERVICES
The Customer, like Internet users, may consult the articles presented by VINTAGE OPERANDI on the Site.
In addition, the Customer may:
- Place one or more item orders,
- Follow the status of his current orders,
- Access their invoices.
For placing an order for items, the Customer must:
- Follow the instructions on the Site and, in particular, the instructions required to connect to the Account and, where applicable, to open an Account,
- Select the item (s) of their choice, it being specified that the selection of items chosen by the Customer may no longer be available depending on the time taken to confirm the order. The Customer must then resume their selection of items from the beginning,
- Check the elements of the order and, if necessary, modify the selection of items and / or correct the delivery and / or billing information,
- Validate the order,
- Choose a payment method,
- Follow the instructions of the online payment service in order to proceed to the secure payment of the amount of the order.
In the event that the total price of the order exceeds the sum of one thousand five hundred (1,500) euros including tax, the validation of the order will be subject, without prejudice to the following paragraph, to material verifications by VINTAGE OPERANDI with the Customer. . Failure to do so, the order cannot be validated.
Once the payment authorization has been validated, the Customer receives a confirmation of payment acceptance and a confirmation of the order.
ARTICLE 08. CHARACTERISTICS OF ITEMS FOR SALE
The articles for sale on the Site are second-hand items so that the available stock may be limited to a few copies or even a single copy. In addition, it is possible that an item is offered for sale both on the Site and in the Showroom. The availability of an item may therefore vary depending on the time required for updating the Site. The Site is updated approximately every 2 hours.
Consequently, the Customer will be immediately informed by VINTAGE OPERANDI, by email, of the unavailability of the item selected when placing an order.
Each item for sale has a sheet describing all of its characteristics, such as the brand, material, size, color and condition.
In this regard, the condition of the item for sale is defined according to the following categories:
- "New condition": the item looks new and is flawless,
- "Perfect Condition": the item has been used very little and remains flawless,
- "Very good condition": the item has been little used and looks very good. It may have some apparent defects,
- "Good condition": the item shows signs of wear and tear,
- "Fair condition": the item shows marked signs of wear.
If necessary, the Customer can contact the sales department using the contact details listed in the "Sales department" Article.
ARTICLE 09. PRICE OF ITEMS FOR SALE
The price of the items is indicated on the Site, in euros, all taxes included and excluding delivery costs. In addition, the prices are understood, where applicable, excluding customs fees and any applicable taxes which will be the sole responsibility of the Customer.
At the time of validation of the order, the price to be paid is inclusive of all taxes.
The period of validity of the offers of items for sale is determined by updating the Site.
ARTICLE 10. TERMS OF PAYMENT
Payment of the price by the Customer is made by one of the following payment methods:
- By credit card (Carte Bleue, VISA, VISA Electron, Eurocard / Mastercard, Maestro), AMEX
In the event of payment by bank card, the transaction is immediately debited after verification of the Customer's bank card data, upon receipt of the debit authorization from the bank issuing said bank card.
In accordance with Article L.132-2 of the Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By providing the information relating to his bank card, the Customer authorizes VINTAGE OPERANDI to debit his bank card for the amount corresponding to the price.
To this end, the Customer must confirm, during the payment process, that he is the holder of the bank card to be debited and that the name appearing on it is indeed his.
In the event that the debit of the price would be impossible, the online sale would be immediately terminated as of right.
ARTICLE 11. DELIVERY OF ITEMS FOR SALE
11.01 MODES AND AMOUNT OF DELIVERY
Delivery is provided anywhere in the world (excluding North Korea).
The Customer is informed that the delivery costs are his responsibility (excluding exceptional promotional operations).
In this regard, when ordering, the Customer chooses one of the delivery methods offered on the Site.
The available delivery methods are as follows:
- By courier only for deliveries in intramural Paris,
- By DHL
The amount of delivery costs, any customs charges as well as any other potential taxes, depends in particular on the delivery method chosen by the Customer as well as on the country of destination.
11.02 DELIVERY TIMES
The delivery times are as follows:
- Eight (8) working days from the validation of the order, for delivery in mainland France (excluding Corsica),
- Fourteen (14) working days from the validation of the order, for delivery abroad or in Overseas France and Corsica.
Delivery times are understood in working days and correspond to the average preparation and delivery times.
The Customer will receive an email informing them of the shipment of their order.
In the event of late delivery, the order is not canceled. VINTAGE OPERANDI will inform the Customer by email.
The Customer can follow the progress of the processing of his order on his Account.
11.03 VERIFICATION OF THE ORDER ON RECEPTION
The Customer is responsible for checking the condition of the packaging as well as the items purchased upon receipt.
It is the Customer's responsibility to make the reservations and complaints he considers necessary, or even to refuse the package, when it is obviously damaged on delivery. Said reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within three (3) working days following delivery.
The Customer must send a copy of the letter addressed to the carrier to VINTAGE OPERANDI.
ARTICLE 12. RIGHT OF WITHDRAWAL
The Customer has a right of withdrawal which he can exercise within fourteen (14) calendar days of the date of receipt or withdrawal of the order. In the event that this period expires on a Saturday, Sunday or a public holiday, it is extended until the next working day.
The Customer who wishes to exercise his right of withdrawal must return the items concerned within the aforementioned period to the address of Showroom 3, rue Rossini 75009 PARIS.
The Customer must return the items in their packaging, if applicable, along with all of the accessories, instructions or other documents.
The Customer is duly informed that the items are all protected by means of a "tamper-evident seal" which must not be broken by the Customer unless he is certain to use the purchased item.

ARTICLE 13. GUARANTEE
VINTAGE OPERANDI is subject to the legal warranty conditions provided for in Articles L.217-7 of the Consumer Code (non-compliance) and 1641 of the Civil Code (hidden defects).
ARTICLE 14. COMMERCIAL SERVICE

In the year following the request to customer service, the Customer may have his request examined by a mediator. PURSUANT TO ARTICLE L.612-1 OF THE CONSUMER CODE, THE CONSUMER HAS THE RIGHT TO RECOURSE FREE OF CHARGE TO A CONSUMER MEDIATOR WITH A VIEW TO AMICABLE RESOLUTION OF THE LITIGATION. TO THIS EFFECT, THE PROFESSIONAL GUARANTEES THE CONSUMER THE EFFECTIVE USE OF A CONSUMER MEDIATION DEVICE. FOR THIS, THE PROFESSIONAL MUST COMMUNICATE THE CONTACT DETAILS OF THE COMPETENT MEDIATOR TO WHICH HE COMES (ART. L.616-1 OF THE CONSUMER CODE).
ARTICLE 15. TERMINATION OF THE GTC
15.01 TERMINATION
The T & Cs constitute a contract concluded between VINTAGE OPERANDI and the Customer taking effect on the date of the Customer's registration.
As this contract is for an indefinite period, each of the parties may therefore terminate it and, therefore, terminate the Client's registration on the Site, without reason or compensation for the other party, with fifteen (15) days' notice when the termination is initiated by VINTAGE OPERANDI and immediately when termination is initiated by the Customer. In the latter case, the Customer simply has to click on the "Delete my account" link and confirm the operation.
However, as long as a sale is in progress, the T & Cs will remain in effect; however, the Customer can no longer purchase a product.
15.02 TERMINATION FOR NON-USE OF THE ACCOUNT
In particular, VINTAGE OPERANDI may terminate a Client's registration to the Site in the event that the Client does not connect to his Account for a period exceeding two (2) years. The former Customer may, however, re-register.
15.03 TERMINATION FOR FAULT
In the event of non-performance by one of the parties of one of its substantial obligations, the termination of this contract may be notified to it by the other party, fifteen (15) days after a formal notice to remedy it, remained without effect, without prejudice to any damages that may be due.
VINTAGE OPERANDI may also, at its convenience, send a notification aimed at reminding the offending Customer of its obligations.
It is specified that VINTAGE OPERANDI reserves the right to terminate any contract binding it to a Customer who has provided false information when registering on the Site or who does not comply with its contractual obligations or the laws and regulations in force. In an emergency, the termination of the T & Cs may be effective immediately, that is to say without any notice or compensation for the benefit of the Customer.
15.04 TERMS OF NOTIFICATION OF TERMINATION
In the event of termination at the initiative of the Client, the latter must click on the link "Delete my Account" and then confirm his desire for deletion.
In the event of termination or suspension of the rights of access to the areas of the Site reserved for the presentation of the Client ID intervening on the initiative of VINTAGE OPERANDI, the notification of the alleged contractual breaches as well as the possible termination of the GTCS are notified to the Customer by email, to the address provided by the latter.
15.05 CONSEQUENCES OF TERMINATION
Access to the Customer's Account is then deleted by VINTAGE OPERANDI as soon as possible.
ARTICLE 16. RESPONSIBILITY
VINTAGE OPERANDI is only responsible for the content of the pages it publishes and the Services it offers.
VINTAGE OPERANDI can in no way be held responsible for any damage likely to occur on the computer system of an Internet user or a Customer and / or the loss of data resulting from the use of the Site by an Internet user or a Customer.
VINTAGE OPERANDI can not be held responsible for facts other than those relating to the edition of the Site and the messages exchanged within the framework of the Services. VINTAGE OPERANDI in no way guarantees the availability or performance of the Site. The liability of VINTAGE OPERANDI can only be sought for direct and foreseeable damage, exclusively caused by a failure by VINTAGE OPERANDI to fulfill its obligations.
In the event that the responsibility of VINTAGE OPERANDI is sought due to a breach by a Customer of the obligations incumbent on him under the terms of the contract binding him to VINTAGE OPERANDI or the laws in force, the Customer guarantees VINTAGE OPERANDI against all sentences pronounced against against VINTAGE OPERANDI or amicable compensation. This guarantee covers both the indemnities which may be paid, as well as the legal fees and legal costs which would be borne by VINTAGE OPERANDI.
ARTICLE 17. FORCE MAJEURE
VINTAGE OPERANDI will not be held responsible for any defect, delay or non-performance of its obligations under the GTC, when this defect, delay or non-performance is related to a case of force majeure.
Expressly, are considered as force majeure or fortuitous events, in addition to those usually retained by French case law: total or partial strikes, internal or external to VINTAGE OPERANDI, lock-out, bad weather, blockages of the means of communication for some reason whatsoever, computer or server failures, electrical or technical problems blocking telecommunications, failure or malfunction of transmission networks via the Internet and any other case beyond the control of the parties, preventing the normal execution of the T & Cs.
In addition, the Customer declares to be aware of the complexity of global networks, the unequal capacities of the different subnets, the influx of users at certain times and the various “bottlenecks” in certain places of Internet. The current protocols of transmission via Internet do not make it possible to ensure in a certain and continuous manner the good reception of the messages and the integrity of the transmitted documents, the responsibility of VINTAGE OPERANDI cannot be sought in the event of poor transmission due to a failure or to a malfunction of these transmission networks.
ARTICLE 18. LANGUAGE OF THE CONTRACT
The French language version of the GTC is the only legally valid version and can only be produced in court.
ARTICLE 19. APPLICABLE LAW AND JURISDICTIONAL COMPETENCE
The GTC are subject to French law.
